Terms of Service

Hours OÜ, Estonian registry code 16434060 (hereinafter Hours) owns and operates time tracking software (hereinafter the Software), which can be used through the websites www.hours24.com and www.hours.ee or through a digital mobile application (Hours - Time tracking).

The Terms of Service include the Privacy Policy published on the Hours website, the Cookie Policy and the information and instructions published on the Hours websites (hereinafter jointly referred to as the Terms). Use of the Hours software cannot be registered without agreeing to the Terms.

1. General terms

1.1. The Software is created for use only by legal persons. If a natural person (consumer) nevertheless registers as a User of the Software in breach of this point 1.1 of the Terms, they do so at their own risk, while knowingly waiving the consumer rights provided to them by law, since they knowingly use the Software in a non-intended manner.

1.2. Hours provides Users only with the Software and its technical capabilities. Hours is not liable for the performance and content of the employment contracts entered by the Users, for the accuracy of the time entered by the Employees, or for the mutual relations between the Employees and the Users.

1.3. Hours keeps the Employees' data entered through the Software confidential. Hours only sees and collects the Users' registration data (company name, e-mail). Hours does not have access to the Employees' data.

1.4. Hours is not liable for the preservation of the Employees' employment contracts and other documents entered by the Users. The Software technology provides maximum security for storing documents, but the User must keep backup copies of the documents themselves.

1.5. Hours has the right to change the Terms and the Price List at any time. The change takes effect from the publication of the Terms on the hours24.com website.

1.6. Failure to read the Terms does not release the User from the obligations arising from the Terms.

1.7. The Terms are governed by the law of the Republic of Estonia and disputes are resolved in Harju County Court.

2. Hours Software and Services

2.1. Hours provides Users with web-based Software through which it is possible to track working time, archive employee data, store work information and documents, manage employment contracts, create process- and working-time-based summaries, distinguish types of work and monitor the work process in real time. The Software can be integrated with accounting programs and various working time registration tools. Employees can register their work both on a mobile device and on a computer, including remotely.

2.2. The Software can also be used on a mobile device by downloading the digital application from the App Store or Google Play portals. The application is free for Users and Employees.

2.3. The Hours Software can be connected with physical working time registration tools (NFC cards, biometric terminals, SmartTrack beacons, etc.). The compatibility of existing tools must be checked in advance by writing about it to info@hours.ee.

2.4. The Hours Software can be integrated with the User's accounting programs and payroll programs. For more detailed information, setup and technical assistance, please contact Hours OÜ at info@hours.ee.

2.5. Hours provides the User with reasonable technical support. Hours responds to the User's request as soon as reasonably possible. If the User's request requires expenses to be incurred, the User reimburses the expenses to Hours in advance as agreed.

3. Copyright

3.1. Any information contained in this Software is subject to copyright protection. The reproduction of said information for commercial purposes without the consent of Hours is prohibited. To obtain written consent, please contact the e-mail address info@hours.ee.

4. Software security

4.1. The Hours Software and its content are kept in a cloud infrastructure, which is a highly secure environment for storing the data and documents of all Users and Employees. To ensure the highest level of security, the following measures are used:

  • information entered through the Hours Software is encrypted (TLS/SSL and encryption of data at rest);
  • Customers' passwords are stored only in hashed form;
  • Regular server maintenance, periodic maintenance work, software and hardware updates;
  • Processing compliant with SOC 2 Type II and ISO 27001 requirements.

4.2. Hours does not have access to any of the Employees' data, information and documents entered by the Users. Nevertheless, Hours has done everything in its power to ensure the preservation of the documents entered and uploaded through the Software about the Employees. Hours is not liable for the activities of external factors (so-called „hackers“) and does not guarantee that the data and documents regarding the Employees in the Software are preserved in unexpected cases.

5. Availability of the Software

5.1. Hours strives to ensure the good and continuous availability of the Software, but does not guarantee its availability at all times in any way, and does not exclude possible disruptions in its operation.

5.2. Hours reserves the right to suspend the availability of its Software content at any time for technical or other reasons without notifying the Users in advance. As a result, Hours is in no way liable for the inconvenience or damage caused by such disruptions.

5.3. Hours is not liable for any damage arising from the activities of third parties, including, but not limited to, the spread of computer viruses and spyware, hacking, or the theft of data (including personal data).

6. Paid user account

6.1. In order to fully use the Software and the Services offered therein, the User must have a User account. The User adds Employees to the User account as sub-users themselves. Only the User, not the Employees, is in a contractual relationship with Hours.

6.2. To register a User account, the User must complete the relevant registration form on the Hours website and agree to the Terms. The User account is opened after the completed registration form has been submitted to Hours.

6.3. Once a month, Hours issues an invoice to the User in accordance with the Price List published on the website and the number of Employees. If the User has agreed special conditions with Hours or has received a discount, the discounted price applies to the User.

6.4. All fees paid by the User are non-refundable. In the event of a delay in payment, Hours may require the User to pay a late payment interest in accordance with the invoice. Hours may suspend or terminate access to the User account if the User breaches the payment terms.

6.5. Upon registering a User account, the User receives a username and password. The User themselves takes the relevant actions to keep the username and password confidential.

6.6. The User may close the User account at any time. Hours deletes the User account after the User closes the account, or on its own initiative after a reasonable time has passed following the cessation of use of the User account.

7. Free trial version

7.1. The User can try the free trial version of the Hours Software for 30 days by registering for it on the website in accordance with the instructions.

7.2. In the trial version, all the features that are available on the paid User account are open to the User.

7.3. After using the Trial version, the User is sent a written question asking whether the User wishes to continue using the software on a paid basis. If the User agrees, Hours begins to send invoices for use.

8. Data of Users and Employees

8.1. Hours has access to and collects only the User's data (name and e-mail). Hours does not have access to the Employees' data or documents entered by the User.

8.2. The Employees' data and contracts entered through the Software, and their performance, are concluded by the Users without the involvement of Hours, and the Users are also liable for the performance of such contracts.

8.3. Users use the Software entirely at their own risk. Hours is not liable for the accuracy, legality, truthfulness, validity and compliance with good practice of the information entered by the Users in the Software.

8.4. Hours has the right to restrict the use of the User's User account if information reaches Hours that the User is using the Hours Software in an unlawful or non-intended manner or otherwise in breach of the Terms.

9. User obligations

The User undertakes to:

  • Comply with these Terms when using the Software.
  • Pay for the use of the User account in accordance with the number of Employees and the Price List.
  • Ensure that the data transmitted by the User when using the Software is not misleading, inaccurate, and does not infringe the rights of third parties.
  • Not upload to the Software materials that contain viruses and other files that harm the normal use of the Software.
  • Keep the password and Username set for using the Software in such a way that they do not fall into the hands of third parties.
  • Not use the Software for fraud or any other unlawful purpose.
  • Not transmit through the Software data, documents or other content that the User has no right to transmit and disclose.

10. Rights and obligations of Hours

10.1. Hours has the right, at its own choice, to either restrict or revoke the User's right to use the Software if the User materially breaches the Terms or does not remedy any breach after a reasonable deadline given by Hours, or if the User does not pay or delays the payment of the invoices issued by Hours.

10.2. Hours is at all times entitled, arising from the development of the Software and in the interests of its better and more secure use, to unilaterally change and supplement the Terms and the Price List.

10.3. Hours does everything in its power to provide the Software service to Users and Employees at all times. If a failure occurs, it resolves it at the first opportunity and provides Users with technical support to a reasonable extent free of charge.

11. Liability

11.1. The User agrees that they use the Software entirely at their own risk and releases Hours from any liability related to the use of the Software or to the possible inaccuracy, misleading nature, inappropriateness or any other circumstance of the information uploaded through the Software.

11.2. Hours is not liable for any infringement that the User has committed against third parties, including for the infringement of intellectual property rights.

11.3. The User agrees to compensate Hours for all costs, damage, claims and expenses (including legal aid costs) arising directly or indirectly from the breach by the User of the Terms or of the provisions of any applicable legal act.

12. Other provisions

12.1. The User understands that the Software is intended for use only by legal persons. When using the Software and/or agreeing to the Terms, Hours provides the service to the User with the User's consent, and therefore the User does not have the right to withdraw from the ordered service in accordance with the special regulation on the consumer's right of withdrawal.

12.2. The User has the right to ordinarily terminate at any time the legal relationship that arose upon agreeing to the Terms, by sending Hours a relevant notice. In such a case, Hours deletes the User's User account and the data uploaded by the User.

12.3. Hours is not liable for any loss of profit, income, decline in goodwill, or for indirect or incidental damage arising from or related to the Terms or the use of the Software, regardless of whether it is contractual or non-contractual damage.
